Dear Friends & Colleagues,
I am pleased to present to you The Long-Term Care Risk Legal Forum 2013-
2014 Defense Firm Membership Directory. All of the firms in this Directory
are currently members of The Long-Term Care Risk Legal Forum. As you know,
only firms that have experience representing the long-term care industry are
invited to join the Forum thus this is a very special and talented group. We are
extremely proud of the quality of the firms that participate in the Forum and
we hope to continue our relationship with them for years to come.
In continuation of our efforts last year, we have included a detailed index
showing where each firm has offices around the United States. Also you will
notice that we have added a section for vendors who have continued to
support the long-term care industry and the efforts of the Forum over the last
few years. It is our hope to continue to expand this section in the years to
come.
In late 2013, we began a campaign to develop a state profile of basic but vital
legal information for all 50 states. Our defense firm members have answered
the call in a large way on this project allowing us to continue to send out
emails with this information on a regular basis. This information is also being
added to The Long-Term Care Risk Legal Forum – Legal Wiki. We are also in
the process of updating the Mediator and Arbitrator database, once again with
our Defense Firm Members and in-house members leading the way on that
project.
Lastly, I am happy to announce that since the launch of the Forum in 2009 we
have not lost one long-term care company from our membership and in fact
we have continued to add more and more long-term care companies to our
ranks now reaching approximately 130 member companies all around the
US. We continue to work to expand the reach of the Forum. This Directory
has been distributed to key players throughout the entire long-term care space
including all of our industry and defense firm members, select vendors,
insurance professionals, third-party administrators and insurance brokers.
I sincerely hope that you will find this directory useful. Thank you for your
support and interest in The Long-Term Care Risk Legal Forum.
Sincerely,
David Johnson

Armbrecht Jackson LLP
Our Long-Term Care and Assisted Living defense team has an enviable track record of
successfully defending nursing homes, rehabilitation facilities, assisted living facilities,
and caregivers in claims and lawsuits involving allegations of malpractice and professional
negligence. We have a large team of lawyers whose practices are primarily
devoted to defending medical professionals, as well as accountants, lawyers, and other
professionals. While our practice is centered in South Alabama, we have defended
cases throughout Alabama and the Southeast.
Defending medical malpractice claims against physicians, nurses, and hospitals for
several decades has provided the depth of experience with the medical community
to be able to efficiently assess and evaluate medical claims, including long-term care
and assisted living claims. If a case must be tried our trial experience in medical cases
gives us the background to successfully and efficiently represent our clients.

Ryley Carlock & Applewhite
Led by Christian Beams and Molly Booker, our litigators defend hospitals, skilled-nursing facilities,
assisted-living facilities, and other medical or long-term care providers against claims of abuse,
neglect, malpractice, and wrongful death. We have represented the interests of elder care
personnel including physicians, nurses, administrators, company executives and other healthcare
workers. If litigation becomes necessary, we evaluate and manage all aspects of the case and serve
our clients through alternative dispute resolution and at trial. We strive to staff cases as efficiently
as possible and work toward a successful, cost-effective outcome.
Over the last 10 years, we’ve successfully defended cases involving allegations of wrongful
death, negligence, abuse, malpractice and violations of Arizona’s Adult Protective Services Act,
where our team handled the pre-litigation investigation, complicated discovery, pre-trial motions,
and standard of care/medical expert witness preparation. In all the cases we’ve managed, we
ultimately achieved a favorable resolution for our clients. Through effective mediation and
arbitration, we often help our clients avoid the time, expense and hardship of going to trial.
We also provide strategic counseling to help our clients avoid litigation. Our assistance includes
advising on changes in laws affecting the elder law industry, developing policies and compliance
programs, and finding other means of managing our clients’ risks.

Hall Booth Smith, P.C.
Federal and State Government involvement in regulation of long-term care is
significantly more aggressive than in any other segment of the healthcare delivery
system. Regulation is so extensive, the long-term care industry has come to be called in
government lingo what is known as a “closely regulated business.” In addition, the
results of these regulatory supervision and inspection actions are widely available
public records, which can make a real impact in litigation.
At HBS, we understand the heightened regulatory environment faced by providers and
can predict and track trends that shape the industry. We constantly monitor
developments in other states to best gauge our approach in Georgia. We not only
practice within the state of Georgia, but frequently consult on out-of-state issues. We’ve
built this knowledge and expertise through a focused familiarity with long-term care
clients; in fact, most of the members of the HBS long-term care group are completely
specialized, representing only long-term care providers. We are available to assist with
all phases of the long-term care practice, from licensure and certification issues, to
the basics of long-term care compliance programs, to Medicare/Medicaid claims and
appeals, to litigation.

BleekeDillonCrandall
BleekeDillonCrandall Attorneys represent nursing homes across Indiana. Representation
of nursing homes often requires a different approach than the traditional medical
malpractice case. From the outset of the case, facts need to be developed to bring the
“institution” that renders the care to life. This requires early meetings with RNs, LPNs,
CNAs, social workers, and other staff to develop the true “story” of all efforts made to
create the best possible living environment for elderly or chronically ill residents.
Nursing home cases also can be very document intensive. BleekeDillonCrandall
Attorneys rely upon paralegal assistance with medical training to organize and highlight
the key medical documents from the vast array of materials available in each case.
In addition, nursing home cases frequently embody high emotions for the families
of residents. BleekeDillonCrandall Attorneys attempt to utilize compassion, coupled
with truth, to allow family members to “be heard,” while also helping them to see
the realities associated with balancing safety concerns, patient dignity and independence.

Adam & McDonald P.A.
We believe achieving the best possible result for a client requires the careful execution
of a well thought out litigation plan. We recognize many disputes may be resolved
before or early in the litigation process. We endeavor to identify such cases, and get
them resolved as early as possible, to minimize legal fees and eliminate the inherent
risks associated with litigation. When a matter can not or should not be resolved,
however, we aggressively represent the interests of our clients.
Most importantly, we are sensitive to the needs of the people with whom we work
and the clients we represent. At all times we keep our clients and claims professionals
informed, and work with them as a “team” to efficiently and successfully resolve
litigation by settlement, dispositive motion, or trial.

professional liability and casualty claims, our attorneys have expertise in defending
a wide range of elder-care and long-term care providers including skilled nursing

acute care providers, rehabilitation facility, and long-term care facilities. We are a
well-respected team of trial lawyers who also understand the value of a reasonable
settlement. Through years of experience, including trials, arbitrations, mediations,
and administrative hearings, we have learned how to efficiently value a claim and
economically defend our clients. We pride ourselves on being creative problem
solvers, competent advocates, and seasoned counsel. We approach every file with the
expectation that trial may be necessary to protect the interests of our client. However,
understanding that trial is not the only option, or always a positive experience, even for
the victor, we constantly weigh and appreciate the possibility of an advantageous
resolution. We enjoy the reputation of a firm with a strong and successful motion
practice and one that has earned the respect of our peers, including our opposing
counsel. We get the job done, and done well.
